Please read these Terms of Service (“Terms”) carefully before using the Chores & Allowance Bot app for iPhone, iPad, Mac, Apple Watch, Android, Wear OS and the web (the “Service”), operated by WingBoat.com LLC (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not use the Service. Our Privacy Policy explains how we handle your information.

Accounts

You must be an adult to create an account. You may let your children use the Service on your devices or on devices you link to your account, and you are responsible for their use of it.

When you create an account, you must provide information that is accurate, complete, and current. You are responsible for safeguarding your password and passcodes and for any activities or actions under your account. Do not disclose your password to anyone else, and tell us immediately if you become aware of any breach of security or unauthorized use of your account.

Subscriptions

The basic features of the Service are free. Premium features are available with a paid subscription (“Subscription”), billed in advance on a recurring basis (monthly, every six months, or yearly, depending on the plan you choose) by the store you buy it from: the Apple App Store, Google Play, or, on the web, our payment processor Stripe.

A Subscription renews automatically at the end of each period at the price then in effect, unless you cancel it at least 24 hours before the end of the current period. You can manage and cancel a Subscription in your App Store account settings (Apple), in the Google Play Store under Payments & subscriptions (Google), or with Manage subscription in the app (web purchases). Cancelling stops the next renewal; you keep Premium until the end of the period you have paid for.

Free Trials

We may offer a Subscription with a free trial for a limited time (“Free Trial”). If you do not cancel before the Free Trial ends, the Subscription begins and you are charged. For purchases in the App Store or Google Play, whether you are eligible for a Free Trial is decided by Apple or Google. We may change or end a Free Trial offer at any time, without affecting Free Trials already started.

Discount Offers

From time to time we may offer a discount on a Subscription, for example a lower price for the first year. The terms of each offer (the discount, how long it lasts, who can use it and when the offer ends) are shown before you buy. When the discounted period ends, the Subscription renews at the regular price unless you cancel it.

Fee Changes

We may change Subscription prices. A price change takes effect at the start of the next billing period after you have been notified, giving you the opportunity to cancel before it applies. Your continued use of the Subscription after a price change takes effect constitutes your agreement to the new price.

Refunds

Refunds for purchases made in the App Store or Google Play are handled by Apple or Google under their refund policies. Except when required by law, paid Subscription fees for web purchases are non-refundable; if you believe you were charged in error, please contact us.

Service Features and Functionality

We may at any time, at our discretion, change, add to, or discontinue the Service or any part of it, temporarily or permanently. You agree that your purchases are not contingent on the delivery of any future functionality or features, or dependent on any oral or written public comments made by us regarding future functionality or features.

Your Content

The Service lets you enter and store information such as children’s names, pictures, chores, allowances and notes (“Content”). You are responsible for the Content you enter, including its legality and appropriateness, and you represent that you have the right to use it. You keep all of your rights to your Content. You give us permission to store, process, copy and display your Content only as needed to provide the Service to you and to the devices linked to your account.

Acceptable Use

You agree not to misuse the Service, including by trying to gain unauthorized access to it or to other users’ accounts, interfering with its operation, or using it for any unlawful purpose.

Copyright Policy

We respect the intellectual property rights of others. If you are a copyright owner, or authorized on behalf of one, and believe that copyrighted work has been copied in a way that constitutes copyright infringement through the Service, send a notice with a detailed description of the alleged infringement to support@wingboat.com, to the attention of “Copyright Infringement”. You may be held accountable for damages (including costs and attorneys’ fees) for misrepresenting that any Content is infringing your copyright.

Intellectual Property

The Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of WingBoat.com LLC and its licensors. The Service is protected by copyright, trademark, and other laws of the United States and other countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

Links To Other Web Sites

The Service may contain links to third-party web sites or services that are not owned or controlled by WingBoat.com LLC. We have no control over, and assume no responsibility for, their content, privacy policies, or practices, and are not responsible or liable for any damage or loss caused by or in connection with the use of them. We strongly advise you to read the terms and privacy policies of any third-party web sites or services that you visit.

Termination

You may stop using the Service at any time, and you can delete your account in the app (Settings, then Account Settings, then Delete Account) or on our Delete My Account page. Deleting your account does not cancel a Subscription bought in the App Store or Google Play; cancel it there.

We may suspend or terminate your account if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

Limitation Of Liability

To the fullest extent permitted by law, in no event shall WingBoat.com LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance. We do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements. Nothing in these Terms limits rights you have under consumer protection laws that cannot be limited by contract.

App Stores

If you downloaded the app from the Apple App Store or Google Play, these Terms are between you and WingBoat.com LLC, not Apple or Google, and your use of the app must also comply with the store’s terms of service.

Governing Law

These Terms are governed by and construed in accordance with the laws of Wyoming, and you irrevocably submit to the exclusive jurisdiction of the courts in that State, except where the law of the country you live in gives you the right to bring proceedings where you live.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We may modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice before the new terms take effect. By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
